They will have to fix anything covered by warranty. So yes, you can make them fix it. I don’t see how it would cost them anything but the time to do the work. the manufacturer would cover the parts needed.

Even if they DO lose money on it, that isn’t your fault that they sold you defective merchandise.

Question by dogi49: Can a car dealership “undo” the deal?
I received a phone call from the dealership after the papers have been signed.. and I paid for my new car, that they did not do the research on my trade in and didn’t realize the vehicle traded in had a Flood Title. (Even though it states this on my registration along with vin number that I faxed to the dealership before they gave me the trade in price) They now want me to bring back my new vehicle that I have already purchased and done the financing for and “undo” the deal. (Because they gave me too high of a trade in price for the old vehicle.) Is this legal? Anyone ever been in a situation like this?

ignore them.the financing has already been approved and submitted and they made the mistake not you. all they are trying to do is get you back in to redo the deal to maximize their profit and your trade might not even be the real issue. the GM might have reviewed the deal and told them to get you back in because they were losing money. it is their problem now.
everything has been signed and it is a contract and they agreed to the terms just like you did. ask yourself this. do you have the option to return the car if you didnt like the deal after you looked it over carefully I:E buyers remorse? so why should you allow them that option?

Question by *~~Peachy~~*: I sold my car last weekend, now the guy wants his money back…?
I have read all the other questions like this and I get the same answer just about every time. But I am just being extra cautious.

I sold a 1995 Saturn SC1 last week to this guy. We negotiated a price of $ 775 because it needed a new radiator and a tune-up. I made sure he knew that my husband drove this car to his job everyday without problems. That the radiator needed to be changed before driving it a long way. He said ok and we made the transaction. I wrote on the biil of sale “Car is sold AS-IS” He signed the title and went and registered it. Now (a week later) he comes knocking on my door saying “We got problems.” He said he took it to a local dealership that checked it out and the mechanic says the rings are bad. He says he wants his money back or me to pay for the repairs. I told him I would check it out and get back to him. I researched it online and found that the lemon laws here in Georgia only apply to dealers and new cars. I, also found that private party sales are not mentioned in the law. I printed out the page from the GOVERNMENT website stating the law and took it to him. He says that there is another law regarding used cars. I have checked it out and found nothing. He informs me that he has an attorney on retainer and he will be contacting him tomorrow about this. I know I told him the car needs repairs and that my husband drove it with no problems. He drove it everyday! The guy test-drove the car and checked the oil and looked the car over really good and still took it home. Does he have the right to demand his money back or take me to court? Or does what I wrote on the bill of sale stand AS-IS?

Let him sue. He will lose. His lawyer will tell him the same thing. AS IS means that. No warranty. You owe him nothing. Tell him to quit calling and to enjoy his new car…………He had a chance to get it inspected before he bought it………….No lemon law on used cars. No he cant return it or demand money back………..md

(We live in Florida, in case state laws are an issue)
I have a friend that bought a used car from a dealer. The dealer “financed” her car. He has a paper that states what he pays on the car w/ interest rate and loan terms. The holder is the dealer. Now they are telling him that he has not officially been financed and they are having a hard time financing him so his interest rate might go up. Is the contract he signed valid? Can the dealer call him and say that the interest rate has to be higher? Can they repossess his car if he does not agree to changing the finance?
They said that if he doen’t commit to signing the new higher interest deal he will have his car repossessed or can be charged with criminal charges, such as “stealing” the vehicle….however he has the keys….what should he do? please help!!!

Well I’m not sure about FL laws but in most states that’s illegal. Essentially what they have done is signed a contract with the buyer at a set term and rate. Now they want to change the terms of the contract after both parties have agreed to the terms and signed off and money has changed hands and possession of the auto has been transferred to the buyer. That is illegal. They cannot renegotiate the terms of an agreement without BOTH parties agreeing to the terms. I would contact the state attorneys generals office and get clarification from them, but it sounds like the classic bait and switch scam. I would also contact your local better business bureau and let them know about this. Good luck!!

Update — I checked with a friend of mine who has some legal background and asked him about this. He agreed with me that what they are trying to do is flat out illegal, especially if they have accepted money from him and transferred possesion of the car to him. He also recommended that you contact the local police and explain the situation to them BEFORE they try to reposses the car. He also mentioned contacting a local lawyer and seeing if they would be interested in taking this on as a contingency case. That means you won’t have to pay the lawyer anything, but if it goes to court the lawyer will get a percentage of anything recovered.

Personally it sounds like a pretty sleezy operation to me and if your friend can get any money he paid back, I would recommend that he get any money he paid back from them and give them back the car.

i don’t need a new or even a newer used car, i have a 02 durango slt fully loaded with 55k on it, but i thought “hey, its a buyers market maybe i could pick up an 07 yukon or something like it”
the sales attitude of “lets make the best deal for us the dealership” still prevails and they were unwilling to go much below blue book.
what has been your experience’s?
they make a ton of $ on used vehicles.
trade in for a 07 yukon is around 16k, and they told me i wouldnt get full trade on my durango so i’m guessing the guy that traded his 07 yukon didnt get full trade on that either.
they werent willing to go below 24k, my math tells me thats about 10k profit. if they dont want to sell for 19k and make 5k profit,
they can lose their buisness, cuz WE aint buying! car sales down 35%

Question by : I’m selling my car on craigslist. Is it safe to accept payments via PayPal?
My car is a 2011 Ford Fiesta, and I’m looking for someone to buy outright or assume the loan. A buyer responded, requesting to pay via PayPal and pick up after the payment had cleared. Is this a scam? How can I avoid having my identity stolen, or my car “bought” with a scam payment?

Likely a scam.

Only accept payment in cash or with a verified transfer of funds from a bank. Once the funds clear, you’re good to go. Paypal money can be revoked by the buyer, and is not necessarily safe. Transactions should take place in person and, preferably, at a bank.
