They will have to fix anything covered by warranty. So yes, you can make them fix it. I don’t see how it would cost them anything but the time to do the work. the manufacturer would cover the parts needed.

Even if they DO lose money on it, that isn’t your fault that they sold you defective merchandise.

I have read all the other questions like this and I get the same answer just about every time. But I am just being extra cautious.

I sold a 1995 Saturn SC1 last week to this guy. We negotiated a price of $ 775 because it needed a new radiator and a tune-up. I made sure he knew that my husband drove this car to his job everyday without problems. That the radiator needed to be changed before driving it a long way. He said ok and we made the transaction. I wrote on the biil of sale “Car is sold AS-IS” He signed the title and went and registered it. Now (a week later) he comes knocking on my door saying “We got problems.” He said he took it to a local dealership that checked it out and the mechanic says the rings are bad. He says he wants his money back or me to pay for the repairs. I told him I would check it out and get back to him. I researched it online and found that the lemon laws here in Georgia only apply to dealers and new cars. I, also found that private party sales are not mentioned in the law. I printed out the page from the GOVERNMENT website stating the law and took it to him. He says that there is another law regarding used cars. I have checked it out and found nothing. He informs me that he has an attorney on retainer and he will be contacting him tomorrow about this. I know I told him the car needs repairs and that my husband drove it with no problems. He drove it everyday! The guy test-drove the car and checked the oil and looked the car over really good and still took it home. Does he have the right to demand his money back or take me to court? Or does what I wrote on the bill of sale stand AS-IS?

Let him sue. He will lose. His lawyer will tell him the same thing. AS IS means that. No warranty. You owe him nothing. Tell him to quit calling and to enjoy his new car…………He had a chance to get it inspected before he bought it………….No lemon law on used cars. No he cant return it or demand money back………..md

Why should I buy a service contract (often referred to as an extended warranty) if a car comes with a powertrain warranty?

    There are over 10,000 components on a vehicle; a powertrain warranty covers only a fraction of these parts.
    A typical powertrain warranty does not cover steering, electrical, suspension, air conditioning, heating, fuel systems, brakes, and convenience packages such as a navigation system.

What does an automobile service contract typically include?

    Comprehensive bumper-to-bumper coverage, including the exhaust system, electrical system, the engine, gas tank, the heater and air conditioner.
    Access to pre-qualified, professional auto technicians
    Twenty-four hour technical assistance
    Automobile extended warranties may also include discounted maintenance, such as oil changes, quick repairs at pre-qualified service centers, towing and rental cars.
    Coverage for normal wear and tear may be available under some, but not all, service contracts.

Should I buy an extended warranty for a used car?

    Buyers of used motor vehicles need the protections offered by extended vehicle warranties for essentially the same reason that new cars buyers do – to cover repairs not included in a manufacturers limited warranty and to continue protection after the warranty runs out.
    Extended Warranties are not insurance. Most dealers offer minimal coverage (at least 30 days) for used vehicles to cover basic repairs but you are responsible for purchasing an extended warranty if you want to cover the cost of repairs beyond any manufacturer’s warranty.
    There are only a few comprehensive warranty programs that will cover the full cost of repairs on your used vehicle. Some of those programs have a high deductible that requires you to pay for a portion of the work upfront.

How are claims handled?

    Nearly 10 million automobile extended service contracts are sold annually, and approximately 95 percent of claims submitted to SCIC member companies are resolved to the customer’s satisfaction.
    A consumer may be able to choose among several service dealers or authorized repair centers. In some cases, the consumer must return the vehicle to the selling dealer for service.
    Many service contracts are backed by A+ rated insurers, who provide additional financial solvency on long-term contracts.
    As with most laws, there may be exemptions from certain requirements. It is important for consumers to research the company offering the service contract as well as any insurer backing it.

Consumer Obligations:

    Read the contract provisions carefully and understand all coverage and exclusions
    Keep detailed records, including contract paperwork, receipts, and maintenance records
    Adhere to all manufacturer’s recommendations for routine maintenance, such as oil and spark plug changes. Failure to do so could void the contract.
    Identify the name of the service contract provider on the contract. If a contract does not list an administrator’s contact information, contact your state Department of Insurance or the Better Business Bureau to determine if the company is authorized to do business in your state.
    Check if the plan’s administrator is a member of the Service Contract Industry Council

Consumer Tips:

    Many, but not all, service contracts cover normal wear-and-tear and may fill in coverage gaps in the manufacturer’s warranty for up to 7 years and/or 100,000 miles
    In many states, service contracts come with a “free look” period, usually 30 days. If a consumer believes they acted impetuously, the contract can be return for a full refund during this period.
    Do not buy a service contract if the provider will not supply you with a copy of the contract terms and conditions prior to purchase.
    Be alert to service contract providers who use unsolicited mass marketing techniques, such as direct mail and telemarketing (e.g. “robo-calls”).

Question by julie a: Can an new car dealership void my warranty on my new car because a “dealer” added option failed after 33 days?
The vehicle I bought new had a dealer added option on it and it failed after 33 days. When I took it to them they said that it was a non ford product added by another dealership before it came to their lot and they were not going to warrantty anything that another dealership put on. There was no “Dealer Added Options” sticker on my car and the bill of sale was typed so that I was paying for this option from the dealership I bought it from.
The stripes were added before it got to the dealership but no where on the paperwork does it say that these were not factory stripes. The dealership that sold me the car did not even know it. Now all they want to do is put the factory stripes on, because they said that they can not keep changing them every 3-4 months, but the look of the car is very different with the stripes that are on it now. Also, I have had 14 others problems with this car in 23 months but online here everyone tends to tell me to “suck it up”. So now not only do I have to tolerate the very faded appearance of the exterior but also the MFG rep told me that I cannot play any non- store bought cd’s in my shaker 500/mp3 stereo., because they cannot find the problem although it has been duplicated 3x’s for them.Fuel tank replaced, passenger seat track replaced, stereo replaced 4 x,reprogram modular 3 x, exterior door handle, both seat
releases,insulation in front of dash, etc.more problem too,but I guess “Suck it up”

Question by JB: Can my neighbor Sue me for selling a used Car “as is” ?
I sold my 1992 Infinity with “No Warranty”. The buyer drove my car to another city that was about 2 hours away to where he lives. Five months later, he sends me letter that he is suing me for FALSE MISREPRESENTATION OR TAMPERING WITH MAINTENANCE ..or something. He is saying I owe him for repairs and the days he missed of work , total coming to be close to five grand. Also, he put on the DMV Bill of Sale that the car was sold for $ 80.00, when it was actually sold for $ 2,300.00 When I go to court how will this play out? Will he really end up taking my money?

Nope, you sold it as is and didn’t guarantee the car would work. Also, the bill of sale was only written out for $ 80.00 so in a worst case scenario…. the court would have you shell out $ 80.00 since that is what was contracted. You don’t owe him for tampering or misrepresenting the car in your front yard.

Let’s just see how it’ll play out, if anything the seller screwed himself by having you change the bill of sale to $ 80.00. Lol.
